1. Introduction and acceptance
Welcome to Kalinga Matrimony, a matrimonial platform serving the worldwide Kalinga community.
Kalinga Matrimony is operated by Kalinga Matrimony Welfare Society, with its registered address at 003-775/GOVINDA NAGAR, BALAGA (RURAL), Srikakulam, Andhra Pradesh, India, 532001 ("Kalinga Matrimony", "we", "us" or "our").
These Terms & Conditions ("Terms") govern your access to and use of Kalingamatrimony.org, including account registration, profile management, searches, shortlists, communications, AI assistance, subscriptions and related services.
"You" means the person accessing or using the platform, including a member seeking a marriage partner or a family representative managing a profile with that member's authorisation.
When you register or purchase a service, you must affirmatively accept these Terms through the acceptance mechanism provided. If you do not agree, you must not register, purchase a service or use features that require acceptance.
Our Privacy Policy explains how we process personal information. Additional terms for a particular paid service apply only when disclosed to you before purchase.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
2. Nature and scope of our services
Kalinga Matrimony provides tools to help members discover potential marriage partners and communicate with them or their authorised representatives.
Depending on the features and membership plan available, services may include:
- Creating and managing matrimonial profiles.
- Searching, filtering and shortlisting profiles.
- Expressing interest and receiving responses.
- Communicating with members or authorised family representatives.
- Receiving profile recommendations.
- Accessing verification features.
- Using AI assistance for navigation, profile preparation and service-related questions.
- Purchasing premium features or other expressly described services.
We facilitate introductions and communication. We do not solemnise marriages, act as a marriage registration authority or make marriage decisions on behalf of members.
Membership does not guarantee a particular number of suitable matches, responses, introductions, meetings, engagements or marriages, unless a specific service commitment is expressly stated in your purchase terms.
3. Eligibility
You must be at least 18 years old and legally capable of accepting these Terms to create or manage an account.
Every person represented in a matrimonial profile must also be at least 18 years old. No parent, relative or representative may create a profile for a minor.
The minimum account age is separate from legal eligibility to marry. You must comply with the marriageable-age requirements and other marriage laws applicable to you. You must not use the platform to arrange, promote or facilitate an unlawful marriage.
A person using the platform to seek a partner must:
- Have a genuine intention to explore a lawful marriage.
- Provide an accurate account of their marital status.
- Be legally free to enter the marriage being sought.
- Participate voluntarily.
- Have authority to provide the information included in their profile.
As a platform eligibility rule, a person whose existing marriage has not legally ended must not present themselves as unmarried or divorced or maintain an active partner-seeking profile. Separation or a pending divorce does not establish that a divorce is final.
You must not use another account to circumvent a suspension or removal.
We may request proportionate evidence of age, identity, marital status or representative authority where reasonably necessary. Information collected for this purpose is handled under our Privacy Policy.
4. Registration and account security
You must provide accurate registration information and keep it reasonably up to date.
You are responsible for protecting your login credentials and for activity you authorise through your account. You are not automatically responsible for unauthorised activity caused by failures for which we are legally responsible.
You must:
- Use contact details you are entitled to use.
- Protect passwords and verification codes.
- Notify us promptly of suspected unauthorised access.
- Avoid selling, renting, transferring or lending an account.
- Avoid creating duplicate or misleading profiles.
- Use any available representative-access features instead of sharing credentials.
Unless we expressly permit otherwise, each person seeking a marriage partner may have only one active matrimonial profile.
We will never require you to disclose a banking password, card PIN or payment OTP to our staff, another member or the AI assistant.
5. Profiles managed by family members
A parent, relative or other representative may create or manage a profile only with the adult member's informed authorisation.
As a representative, you agree to:
- Explain the service and these Terms to the person represented.
- Obtain their permission before submitting personal information or photographs.
- Identify your relationship to them accurately.
- Keep them informed of material communications and proposed introductions.
- Respect their preferences, decisions and privacy choices.
- Stop acting on their behalf when your authority is withdrawn.
You must not impersonate the person represented or conceal that a communication is being sent by a family representative.
Paying for a membership does not give a representative ownership of another adult's profile, personal information or marriage decisions.
The person represented may contact us directly to request changes to profile management or removal of an unauthorised profile. We may verify identity and temporarily restrict access while resolving a dispute.
Any legally recognised guardianship arrangement will be considered under applicable law. Family involvement must never involve coercion or forced marriage.
6. Profile accuracy and verification
You are responsible for the accuracy of information you submit, including age, photographs, education, occupation, income range, location, community information and marital status.
Photographs must represent the person identified in the profile. You must not use another person's photographs, fabricated identities, misleading AI-generated portraits or materially deceptive alterations.
You must update your profile when an important fact changes. If you are no longer seeking a partner, you should hide or close your profile.
We may review information, request clarification or restrict profiles that appear incomplete, misleading, fraudulent or inconsistent with these Terms.
Verification badges relate only to the checks described for that badge. For example, verifying a mobile number does not verify employment, financial circumstances, marital status or character.
Verification is not an endorsement, background guarantee or assurance of compatibility. You remain responsible for making appropriate enquiries before relying on another member's statements or entering a relationship.
7. Respectful conduct and prohibited activities
You must use the platform lawfully, respectfully and for its intended matrimonial purpose.
You must not:
- Harass, stalk, threaten, intimidate, blackmail or abuse anyone.
- Continue contacting a person after they decline further communication.
- Circumvent a block using another account, relative or external contact method.
- Demand dowry or facilitate unlawful financial demands connected with marriage.
- Promote forced marriage, child marriage, trafficking or exploitation.
- Request money, loans, investments, cryptocurrency transfers or financial assistance from members.
- Run romance scams, fraudulent introductions or deceptive schemes.
- Publish obscene material, unsolicited sexual content or non-consensual intimate imagery.
- Create or circulate deceptive deepfakes or impersonations.
- Publish another person's private information without permission.
- Make threats or derogatory attacks based on caste, religion, community, gender, disability or another personal characteristic.
- Upload unlawful content or material that infringes intellectual property or privacy rights.
- Send spam, advertisements, recruitment messages or unrelated commercial solicitations.
- Operate as an undisclosed broker or commercial matchmaking agent without our written authorisation.
- Submit deliberately false reports or misuse grievance mechanisms.
- Introduce malware, compromise accounts or interfere with platform security.
- Scrape profiles, bulk-download photographs or harvest contact details.
- Use bots, automation or unauthorised tools to bypass access controls, usage limits or payment requirements.
- Use member information to train AI systems, build external databases or conduct surveillance.
- Attempt to access private information or internal systems through the AI assistant or any other feature.
We may act against conduct outside the platform where reliable information establishes a relevant threat to members or misuse of information obtained through the service.
8. Privacy, contact sharing and member information
You must use information obtained through Kalinga Matrimony only for legitimate, consensual matrimonial communication.
Access to a profile does not authorise you to republish it, circulate screenshots, distribute photographs or contact the person through unrelated channels without permission.
Premium access does not override another member's privacy settings, contact-sharing choices or refusal to communicate.
If you receive contact details through an authorised feature, you must respect the person's preferences and stop contact when requested.
Our processing of personal information is governed by the Privacy Policy. Acceptance of these Terms is not blanket consent to optional marketing, sensitive-data processing or other activities requiring separate consent.
9. User content and permissions
"User Content" includes profile information, photographs, descriptions, messages, attachments, feedback and other material you submit.
You retain any ownership rights you hold in your User Content.
You grant us a non-exclusive, royalty-free permission to host, store, reproduce, format, transmit and display your User Content only as reasonably necessary to:
- Provide the services you request.
- Display profiles according to applicable permissions.
- Deliver communications to their intended recipients.
- Perform moderation, safety and support functions.
- Comply with legal obligations.
We may permit service providers acting on our behalf to perform these activities subject to appropriate restrictions.
This permission does not authorise us to sell your photographs, use your identity in advertising or train general-purpose AI models on private content. Publicity, testimonials and success stories require separate permission.
The permission ends when the relevant content is deleted, except to the extent necessary for lawful retention, protected backups, communications already delivered or other purposes explained in the Privacy Policy.
You confirm that you have the rights and permissions needed to submit the content. We may remove or restrict content that violates these Terms or applicable law.
10. AI assistance and recommendations
Our AI assistant may help you navigate the platform, understand features, prepare profile text or express preferences.
AI responses and recommendations may be inaccurate, incomplete or unsuitable for your circumstances. Review generated text before submitting or sharing it.
AI-generated statements about another person must not be treated as verified facts. Matching recommendations, compatibility indicators and astrological interpretations, where offered, do not establish that a person is suitable or that a marriage will succeed.
The AI assistant does not provide professional legal, medical, financial or psychological advice.
You must not:
- Submit unnecessary sensitive information or confidential information about others.
- Ask the assistant to impersonate another member.
- Use generated content to misrepresent your identity or circumstances.
- Attempt to reveal private profiles, credentials or internal instructions.
- Use the assistant for prohibited or unlawful activities.
AI responses do not amend these Terms, approve refunds or create contractual commitments unless the relevant action is confirmed through an authorised account or transaction process.
You may contact human support to question an AI response or request review of an account decision affecting you.
11. Free and premium services
Some services are available without payment. Others require a subscription or separate purchase.
Before payment, we will disclose the material purchase terms, including:
- The service or plan being purchased.
- Included features and material limits.
- The subscription duration.
- The total price, currency and applicable taxes or charges.
- Whether the purchase renews automatically.
- Cancellation and refund conditions.
- Any relevant activation requirements.
Terms such as "unlimited", where used, remain subject to reasonable limits disclosed before purchase and restrictions against spam, automation and abuse.
Payment purchases the described service or access. It does not purchase another member's attention, agreement to communicate, personal information beyond their permissions or acceptance of a marriage proposal.
We will not materially reduce purchased benefits during an existing paid term without providing an appropriate remedy where required.
12. Payments, renewals and price changes
You must use a payment method you are authorised to use.
Payments are processed through the provider identified at checkout. Your bank or payment provider may apply currency-conversion or other charges under its own terms.
Automatic renewal applies only if it is clearly disclosed and you expressly authorise recurring payments. The renewal amount or calculation method and billing frequency must be presented before authorisation.
Where automatic renewal is enabled:
- You may cancel future renewal through the account billing controls or by contacting support.
- Cancellation must be received before the next scheduled charge to prevent that charge.
- Cancellation instructions and any applicable processing cutoff will be disclosed.
- We will provide renewal notices where required by law.
Cancelling renewal ordinarily leaves paid access available until the end of the current term.
Price changes apply prospectively. Changes affecting a recurring subscription will be notified before the relevant renewal, with an opportunity to cancel and any further authorisation required by law.
We will not retrospectively increase the price of an already purchased fixed term.
13. Cancellation and refunds
You may cancel future subscription renewals at any time using the available billing controls or by contacting support.
Unless checkout terms or applicable law provide otherwise, cancelling after a paid term has started does not automatically entitle you to a refund for the portion already used or the remaining period of a functioning service made available as purchased.
Finding a partner, changing your mind, receiving fewer responses than expected or choosing not to use available features does not by itself establish a service failure.
This does not restrict rights arising from:
- Duplicate or incorrect charges.
- Unauthorised transactions.
- Failure to activate or deliver a purchased service.
- Material misdescription of the service.
- Deficient service or breach of an express commitment.
- Applicable cooling-off, withdrawal, cancellation or other consumer rights.
Depending on the circumstances and applicable law, a remedy may include correction, restored access, an extension, a partial refund or a full refund.
Where we permanently discontinue a prepaid service and cannot provide an acceptable equivalent, we will refund the unused portion, unless a different remedy is required by law.
To request a refund, contact [billing support email] with your account identifier, transaction reference and reason. Do not send full card details or banking credentials.
We will communicate our decision and any applicable processing timeframe. Approved refunds will normally be returned through the original payment method unless another lawful arrangement is agreed.
Any promotional refund or satisfaction guarantee applies according to the terms presented with that offer.
14. Member interactions and personal safety
You decide whether to respond, communicate, meet or proceed with a relationship. Consent to one interaction does not imply consent to further contact or a marriage.
Before making important decisions, independently assess relevant information and seek appropriate advice where needed.
For your safety:
- Do not send money or financial credentials to other members.
- Avoid sharing unnecessary identity documents or private addresses.
- Arrange initial meetings in suitable public places.
- Inform someone you trust about an in-person meeting.
- Report suspicious conduct promptly.
We may assist with reports and platform-related concerns, but we cannot supervise every interaction or resolve every personal or family dispute.
These provisions do not exclude responsibility we may have for our own conduct or failures under applicable law.
15. Reports, moderation and complaints
You may report suspected fraud, harassment, impersonation, unauthorised profiles, privacy misuse or other violations through the available reporting controls or the contact details below.
Provide sufficient information to identify the relevant profile or content and explain your concern. Supporting evidence should be relevant and obtained lawfully.
Depending on the issue, we may:
- Request clarification or supporting information.
- Remove or restrict content.
- Limit messaging or profile visibility.
- Require additional verification.
- Suspend or terminate access.
- Preserve relevant records.
- Respond to lawful requests from competent authorities.
We may act immediately where reasonably necessary to address a safety risk, fraud, legal obligation or serious breach.
Where appropriate and legally permitted, we will explain the action and provide an opportunity to request review. We may withhold details where disclosure would compromise an investigation, another person's privacy or platform security.
A report does not automatically establish wrongdoing. We assess reports according to the available information and applicable obligations.
16. Suspension, termination and account closure
You may request account closure through available account controls or by contacting support.
We may restrict or terminate access where reasonably necessary because of:
- A material or repeated breach of these Terms.
- Fraud, impersonation or serious safety concerns.
- Failure to meet eligibility requirements.
- Unresolved concerns about representative authority.
- Failure to pay for a paid service.
- A legal requirement or valid authority order.
We will take proportionate action and provide notice where appropriate. Immediate action may be necessary in urgent cases.
If we terminate a paid service for reasons unrelated to your breach, we will provide an appropriate refund for the unused period.
Where termination follows your breach, any refund will be assessed under the purchase terms and applicable law. Termination does not automatically permit us to retain amounts that must legally be refunded.
We will not initiate renewal charges after account closure takes effect. Any recurring mandate you established directly with an external payment provider should also be cancelled through that provider where necessary.
Profile removal, data deletion and lawful retention are governed by the Privacy Policy.
17. Platform intellectual property
The Kalinga Matrimony name, logos, interface, software, original platform content and related intellectual property belong to us or our licensors, except for User Content and third-party materials.
We grant you a limited, personal, non-exclusive and non-transferable right to use the platform for its intended purpose, subject to these Terms.
You must not copy, commercially exploit, redistribute or create unauthorised derivative works from protected platform materials.
You must not reverse engineer the platform except where applicable law expressly permits it.
Nothing in these Terms transfers ownership of our intellectual property to you.
18. Third-party services
The platform may integrate with or link to payment providers, verification services, sign-in providers, communication services and other third parties.
Separate terms may apply when you independently use those services. We will identify material third-party conditions where relevant to a purchase or feature.
A link or integration does not automatically constitute endorsement of every statement or service provided by a third party.
We remain responsible for obligations that applicable law places on us in relation to providers acting on our behalf.
19. Availability and service changes
We aim to provide a reliable service, but temporary interruptions may occur because of maintenance, updates, network failures, security incidents or events beyond reasonable control.
We may update features to improve functionality, accessibility, safety or legal compliance.
We will give reasonable notice of significant planned changes where practicable. Where a change materially affects a prepaid service, we will provide an appropriate remedy under Section 13 and applicable law.
We do not guarantee uninterrupted access or continued availability of a particular member's profile. Members may withdraw, change their preferences or close their accounts.
Events beyond our reasonable control do not remove obligations to provide refunds or other remedies where legally required.
20. Disclaimers and responsibility
We will provide the services with reasonable care and skill and in accordance with commitments we expressly make.
However, we do not guarantee:
- The truth of every statement made by another member.
- Another person's intentions, behaviour or continued availability.
- Compatibility, engagement, marriage or relationship outcomes.
- The accuracy of every AI response or recommendation.
- That all misuse can be prevented before it occurs.
Member decisions and interactions remain their own. We are not a party to an engagement, marriage, personal loan, gift or other private arrangement between members.
These qualifications do not excuse misleading statements made by us, failure to deliver purchased services or other conduct for which we are legally responsible.
21. Liability
To the extent permitted by applicable law, neither party is responsible to the other for losses that were not reasonably foreseeable when the relevant agreement was entered into.
Because the platform is offered for personal matrimonial use, we do not accept liability for business losses arising from unauthorised commercial use, except where applicable law requires otherwise.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited.
Nothing limits mandatory consumer remedies, statutory privacy rights or responsibility that the law places on us for our own acts or omissions.
22. Claims arising from unlawful use
To the extent permitted by law, you are responsible for reasonable, documented third-party claims and direct losses caused by your fraud, intentional unlawful conduct or knowing infringement of another person's rights through the platform.
This responsibility applies only to the extent caused by your conduct. It does not cover losses caused by our own breach, negligence or misconduct.
If we seek recovery relating to a third-party claim, we will notify you promptly, allow a reasonable opportunity to participate in the response and avoid settlements imposing obligations on you without your consent, which must not be unreasonably withheld.
This section does not impose liability merely because another member makes an unsubstantiated allegation.
23. Governing law and dispute resolution
These Terms are governed by the laws of India, subject to mandatory protections that apply to you in another jurisdiction.
If a dispute arises, you may contact our grievance team so that we can attempt to resolve it. This process does not prevent you from seeking urgent relief, contacting a regulator or exercising statutory remedies.
Subject to applicable law, the competent courts at [city and state with a genuine jurisdictional connection to the operating entity], India, may hear disputes arising from these Terms.
This provision does not remove the jurisdiction of a competent consumer commission or another forum available to you under mandatory law. It does not require you to waive the right to bring a claim in a jurisdiction where that right is legally protected.
No compulsory arbitration requirement is created by these Terms.
24. Changes to these Terms
We may update these Terms to reflect changes to the service, business practices or legal requirements.
The current version will display its effective date. We will provide appropriate advance notice of material changes, except where immediate changes are necessary for legal or urgent security reasons.
Changes will not retrospectively remove accrued rights, alter completed transactions or reduce existing paid entitlements without an appropriate remedy.
Where affirmative acceptance is legally required, we will request it. If you do not accept a material change, you may stop using the affected service and exercise any applicable cancellation or refund rights.
25. General provisions
If a provision is found unenforceable, it will be limited or separated to the extent necessary, and the remaining provisions will continue to apply.
A delay in enforcing a provision does not waive the right to enforce it later.
We may transfer the operation of the service or our contractual rights and obligations as part of a lawful business transfer, provided this does not reduce your contractual or statutory protections. We will notify you where required.
You may not transfer your account or membership without our written agreement.
These Terms and the purchase-specific terms accepted by you form the agreement relating to your use of the service. The Privacy Policy governs our processing of personal information.
Where a translation is provided, we aim to preserve the same meaning across languages. Any interpretation remains subject to applicable law and the information presented to you when you accepted the agreement.
